South Korea's Moon says cannot recognize North Korea as nuclear state-[Reuters]-By Christine Kim and Ben Blanchard-YAHOONEWS-November 1, 2017

SEOUL/BEIJING (Reuters) - South Korea will never tolerate North Korea as a nuclear state, nor will Seoul have nuclear weapons, President Moon Jae-in said on Wednesday, as China pledged to work on denuclearization after setting aside a dispute with Seoul over an anti-missile system. The North Korea nuclear crisis will take center stage when U.S. President Donald Trump begins a trip to Asia at the end of the week and diplomacy has being ramping up ahead of that visit.A series of weapons tests by Pyongyang and a string of increasingly bellicose exchanges between Trump and North Korean leader Kim Jong Un in recent months has raised fears about an armed conflict.Speaking to parliament, Moon said there can be no military action on the Korean peninsula without the South's consent, adding the government will continue working for peace on the peninsula."According to the joint denuclearization declaration made by North and South Korea, we cannot tolerate or recognize North Korea as a nuclear state. We too, will not develop nuclear (weapons) or own them," he said."Our government was launched in the most serious of times in terms of security. The government is making efforts to stably manage the situation it faces as well as to bring about peace on the Korean peninsula."China's foreign ministry said Beijing and Seoul will continue to use diplomatic means to address the Korean peninsula issue, after a meeting in Beijing between Lee Do-hoon, South Korea's representatives of stalled six-party nuclear talks, and his Chinese counterpart, Kong Xuanyou.Moon's remarks and China's statement came a day after China and South Korea agreed to normalize relations to end a year-long standoff over the deployment of the U.S. Terminal High Altitude Area Defense (THAAD) system. The installation of THAAD had angered China, which feared its powerful radar could see deep into China. South Korea's tourism, cosmetics and entertainment industries bore the brunt of a Chinese backlash, although Beijing has never specifically linked that to the THAAD deployment.-WARMER TIES-North Korea's state media had no comment on the shift in ties between South Korea and China as of midday on Wednesday. It has not engaged in missile tests since mid-September or any nuclear tests since its biggest one early that month.A senior Blue House official had said warmer bilateral ties had seemed to come about from better trust in Seoul by Beijing, which has expressed concerns regarding possible additional deployments of a U.S. anti-missile defense system and military cooperation among South Korea, the United States and Japan.Earlier this week, South Korea's Foreign Minister Kang Kyung-hwa had said South Korea has no intention to join a U.S. missile-defense system in the region and would not host additional THAAD batteries. South Korea would not enter any trilateral military alliance with the United States and Japan, Kang added. The United States is deciding whether three aircraft carriers currently in the Asia Pacific will carry out an exercise to coincide with Trump's trip to the region, two U.S. officials said. Japan's navy is considering sending one or more ships to the exercise if it is held, a Japanese government source said.Trump's trip includes Tokyo, Seoul and Beijing but he will not go to the heavily fortified demilitarized zone (DMZ) on the border of North Korea and South Korea, a senior White House official said.COOPERATION, COMMUNICATION-China's top newspaper, the Communist Party's official People's Daily, wrote in a commentary on Wednesday that China expected South Korea to take seriously its responsibility to protect regional peace now that they had set relations back on the correct track."The appropriate handling of the THAAD issue by China and South Korea can provide an opportunity for both countries to increase cooperation and communication on the peninsula issue," it said. But influential state-run tabloid the Global Times warned there would not be an immediate improvement in cultural and business ties, with South Korean firms having to make an effort to win back Chinese customers."Whether or not Chinese consumers buy South Korean products is not totally up the Chinese government," it said in an editorial. The rapprochement meant both countries were able to walk away with gains, said John Delury, professor at Seoul's Yonsei University."It is arguably Moon's first foreign policy breakthrough, giving South Korea's economy a boost and enhancing his geopolitical leverage by strengthening the relationship with China," said Delury."But Xi can also claim a victory - he made his point that Seoul needs to factor China's interests more seriously into its security posture, at least when it comes to things like missile defense that can alter the regional balance of power."(Reporting by Christine Kim and Ben Blanchard; Additional reporting by Soyoung Kim and James Pearson in SEOUL, Nobuhiro Kubo and Tim Kelly in TOKYO; Editing by Lincoln Feast)

NYC truck attack: Investigators scour driver's background-[The Canadian Press]-YAHOONEWS-November 1, 2017

NEW YORK — Investigators worked through the night to determine what led a truck driver to plow down people on a riverfront bike path near the World Trade Center, brandishing air guns and yelling "God is great" in Arabic as his deadly route of terror ended with a crash, authorities said.Eight people were killed and 11 seriously injured in a Halloween afternoon attack that the mayor called "a particularly cowardly act of terror." The driver — identified by officials as an immigrant from Uzbekistan — was in critical condition but expected to survive after a police officer shot him in the abdomen.A roughly two-mile stretch of highway in downtown Manhattan was shut down for the investigation. Authorities also converged on a New Jersey home and a van in a parking lot at a New Jersey Home Depot store. Authorities were scrutinizing a note found inside the attacker's rented truck, according to two law enforcement officials who were not authorized to discuss the ongoing investigation and spoke on the condition of anonymity.Police and the FBI urged members of the public to give them any photos or video that could help. The attack echoed a strategy that the Islamic State group has been suggesting to its followers. While police didn't specifically blame any group for the strike, President Donald Trump railed against the Islamic State and declared "enough!" and "NOT IN THE U.S.A.!"The victims reflected a city that is a melting pot and a magnet for visitors: One of the dead was from Belgium. Five were from Argentina and were celebrating the 30th anniversary of a school graduation, according to officials in those countries. The injured included students and staffers on a school bus that the driver rammed."This was an act of terror, and a particularly cowardly act of terror aimed at innocent civilians, aimed at people going about their lives who had no idea what was about to hit them," said Mayor Bill de Blasio, a Democrat.Officials who were not authorized to discuss the investigation and spoke on the condition of anonymity identified the slight, bearded attacker as Sayfullo Saipov, a 29-year-old who came to the U.S. legally in 2010. He has a Florida driver's license but may have been staying in New Jersey, they said.Records show Saipov was a commercial truck driver who formed a pair of businesses in Ohio. He had also driven for Uber, the ride-hailing company said. An Ohio marriage license shows that a truck driver with one of Saipov's addresses and his name, spelled slightly differently, married a fellow Uzbek in 2013.During his time in Fort Myers, Florida, several years ago, Saipov was "a very good person," an acquaintance, Kobiljon Matkarov, told The New York Times."He liked the U.S. He seemed very lucky, and all the time, he was happy and talking like everything is OK. He did not seem like a terrorist, but I did not know him from the inside," Matkarov said. He said Saipov later moved to New Jersey and began driving for Uber. San Francisco-based Uber said he started over six months ago.Police said the attacker rented the truck at about 2 p.m. at a New Jersey Home Depot and then went into New York City, entering the bike path about an hour later and speeding toward the World Trade Center, the site of the deadliest terror attack in U.S. history. He barrelled along the bike path in the truck for the equivalent of about 14 blocks, or around eight-tenths of a mile, before slamming into a small yellow school bus."A person hopped out of the car with two guns and started yelling and screaming," said a 12-year-old student who had just left a nearby school. "They were yelling 'Allahu Akbar.'"The student, whose mother asked that his name be withheld, said he ran back into the school, where students cried and huddled in a corner.Video shot by bystanders showed Saipov walking through traffic wielding what looked like two handguns, but which police later said were a paintball gun and a pellet gun. A police officer shot Saipov when he wouldn't drop the weapons, police said. The mayhem set off panic in the neighbourhood and left the pavement strewn with mangled bicycles and bodies that were soon covered with sheets."I saw a lot of blood over there. A lot of people on the ground," said Chen Yi, an Uber driver. The note inside the truck was handwritten in a foreign language, according to one of the two law enforcement officials who spoke about the document. Both said its contents were being investigated but supported the belief the act was terrorism.Uzbekistan President Shavkat Mirziyoyev sent his condolences to the president and the families of the victims on Wednesday, and offered his country's assistance in investigating the attack.New York Gov. Andrew Cuomo, a Democrat, called Tuesday's carnage a "lone wolf" attack and said there was no evidence to suggest it was part of a wider plot.New York and other cities around the globe have been on high alert against attacks by extremists in vehicles. England, France and Germany have seen deadly vehicle attacks in the past year or so.___Associated Press writers Sadie Gurman in Washington; Jake Pearson, Tom Hays, Adam Geller, Jennifer Peltz and Tom McElroy in New York; Michael Balsamo in Los Angeles; and Michael R. Victims on bike path included 30th high school reunion group-[The Canadian Press]-YAHOONEWS-November 1, 2017

NEW YORK — The victims of the bike path attack near the World Trade Center included five Argentines, part of a group of friends celebrating the 30th anniversary of their high school graduation with a trip to New York City. The Argentine foreign ministry identified them as Ariel Erlij, Hernan Diego Mendoza, Diego Enrique Angelini, Alejandro Damian Pagnucco, and Hernan Ferruchi. In addition, it says Martin Ludovico Marro was recovering from injuries at Manhattan's Presbyterian Hospital. The victims were among eight friends celebrating the anniversary of their 1987 graduation from the Polytechnic School of Rosario, Argentina, with a U.S. trip to New York and Boston, where their classmate, Marro, lives.Argentina's consul in New York, Mateo Estreme, told La Capital in Rosario that the four survivors in the Argentine group are in a state of shock. Only days earlier, before flying to the U.S., they had posed for a group photo, all of them wearing T-shirts with the word "Libre," or Free. The trip was paid for by Erlij, the chief executive of Ivanar, an Argentine steel products manufacturing company, according to Argentina's La Nacion newspaper. Several other victims were architects."Four died at the scene and another young man died when he was taken away by an ambulance," Jose Nunez, a national deputy who was a friend of several of the men, told La Nacion. The government said it expresses its most sincere condolences and that all Argentines are sharing in this terrible moment of profound sadness. The Associated Press.

Russia's Medvedev says the world shouldn't be dominated by one currency-[Reuters]-YAHOONEWS-November 1, 2017

BEIJING (Reuters) - Russia and China were considering linking their national payment system, Russian Prime Minister Dmitry Medvedev said on Wednesday, as he called for a more balanced global finance structure.Noting the rise of China's Unionpay system and Beijing's efforts to internationalize its currency, the yuan, Medvedev told a press conference in Beijing that Russia was developing its own payment system, known as Karta Mir."At the present moment it is being discussed whether Karta Mir should be linked to Chinese payment systems," he said, while standing alongside Chinese Premier Li Keqiang. That would have "good prospects" and "avoid those problems that sometimes arise when you use American payment systems", Medvedev said, mentioning Visa and Mastercard without elaborating.Russia started to create the Karta Mir system after Western sanctions were imposed on the country in 2014, during the Ukraine crisis. The system is now widely accepted in Russia. After new U.S. sanctions were imposed, Moscow promised to intensify work to cut dependence on Western payment systems further. Among other things, it wants to create more domestic financial services such as its own ratings agency."I think that the more financial instruments there are in the modern world, the more stable the global financial system will be," Medvedev said.Visa and MasterCard stopped providing services to clients of one Russian bank after Washington imposed sanctions over Moscow's annexation of Crimea from Ukraine and support of pro-Russian separatists in eastern Ukraine.Around 14 million Mir cards, which translates as "World" or "Peace", have been issued in Russia, according to the Russian National System of Payment Cards (NSPK), or about 10 percent of the country's population.NSPK was established in 2014 and is 100 percent owned by the central bank.More than 380 banks working in Russia accept the cards, which are issued by 120 banks. Practically all trade and service points, including cafes, shops, restaurants and petrol stations, accept them.Mir cards are also welcome in sanctions-hit Crimea where Western banks are banned from operating.(Reporting by Tom Daly and Beijing Monitoring Desk; editing by Katya Golubkova and Larry King)

Suspected Islamist arrested after knife attack near Tunis parliament-[Reuters]-YAHOONEWS-November 1, 2017

TUNIS (Reuters) - A suspected Islamist militant was arrested on Wednesday after wounding two policemen in a knife attack near the parliament building in Tunis, Tunisia's interior ministry said. The assailant was known to authorities and said after the attack that he considered the police to be "tyrants", according to the statement. One of the policemen was taken to hospital for treatment after being wounded in the neck, while the other was only lightly wounded, it said.Large numbers of police were deployed to the Bardo square in the aftermath of the attack, a witness said. Blood could be seen on the ground in the square. The square is opposite the parliament building and close to the Bardo museum, the site of an attack against foreign tourists that killed 21 people in March 2015.Tunisia suffered two other major attacks that year, one against tourists at the beach resort of Sousse and the other against presidential guards in the capital.Since then, security has been boosted at strategic sites while authorities have cracked down on militants, dismantling dozens of cells.(Reporting by Tarek Amara; Writing by Aidan Lewis; Editing by Catherine Evans and Peter Graff)

Libyan coast guard intercepts nearly 300 migrants east of Tripoli-[Reuters]-YAHOONEWS-November 1, 2017

TRIPOLI (Reuters) - Libya's coastguard intercepted 299 migrants from sub-Saharan African countries on two rubber boats east of Tripoli on Tuesday, officials said. The migrants were intercepted near the town of Zliten by one of several coastguard vessels that Italy repaired and delivered to Libya earlier this year.Libya's western shoreline is the main departure point for migrants trying to reach Europe by boat, many of them fleeing conflict or poverty.Crossings have dropped sharply since July, when an armed group in the smuggling hub of Sabratha began blocking departures.Under pressure from Italy and other European states, Libya's coastguard has also become increasingly active, patrolling more widely and intercepting migrants before they can reach international rescue vessels. As of Oct. 24, more than 18,800 migrants had been intercepted so far this year, according to the International Organisation for Migration. More than 111,000 had crossed to Italy, the vast majority from Libya. The group picked up on Tuesday was brought back to Tripoli port and was being transferred to a detention center in Tajoura, a suburb of the capital. It included about 15 children and 25 women, said coastguard official Ali al-Shebrak.A reporter saw one newborn child crying from hunger as his mother, barely able to walk, was given medical treatment from an ambulance.(Refiles to correct day of week from Thursday to Tuesday)(Reporting by Ahmed Elumami; Editing by Aidan Lewis and Peter Cooney, Larry King)

Hamas cedes Gaza border crossings to Palestinian Authority control-[Reuters]-By Nidal al-Mughrabi-YAHOONEWS-Nov 1, 2017, 6:25 AM

GAZA (Reuters) - The Islamist group Hamas began ceding control of the Gaza Strip's border crossings with Israel and Egypt to U.S.-backed Palestinian President Mahmoud Abbas on Wednesday under an agreement brokered by Cairo to end a decade of internal schism. The move marked the most concrete implementation of the Oct. 11 reconciliation deal that Palestinians hope will ease economic restrictions on Gaza and enable more fruitful negotiations on their goal of setting up an independent state.Israel and the United States have reservations about the intra-Palestinian pact, however, given refusals by Hamas - which has fought three wars with Israel since seizing control of Gaza from Abbas in 2007 - to relinquish its rockets and other arms.Witnesses said that employees from Abbas's Palestinian Authority (PA) moved into Erez and Kerem Shalom crossings on the Israeli border and Rafah crossing on the Egyptian border, as Hamas counterparts packed up equipment and departed on trucks. At Rafah, large murals of Abbas and Egyptian President Abdel Fattah al-Sisi decorated the entrances to the passport hall and Palestinian and Egyptian flags flew over the compound.Citing security concerns, Israel maintains tight restrictions on the movement of people and goods at its crossings with the Gaza Strip, including an almost blanket ban on exports from the territory.Egypt, which in the past has accused Hamas of aiding an Islamist insurgency in its Sinai peninsula bordering Gaza, has kept Rafah largely closed. Hamas denies the allegations and has stepped up security along the frontier.Ministers from the Abbas-backed government of national consensus have begun gradually to assume their duties in Gaza in past weeks and on Tuesday took over the revenue accounts of the Rafah and Kerem Shalom crossings, officials said.Hamas had used those revenues - taxes and fees collected from merchants and passengers - as part of its Gaza budget, to pay salaries of the 40,000 to 50,000 employees it has hired since 2007. Those wages will now be paid by the PA, under the Cairo agreement.Hamas also maintains an armed wing, which analysts say has at least 25,000 well-equipped fighters. It remains the dominant force in Gaza, an enclave of two million people. The Palestinian Authority will begin operating the Erez and Kerem Shalom crossings immediately, officials said, while in Rafah the operation will await further security arrangements such as deploying a force from Abbas's presidential guards and Cairo completing innovations on its side of the facility.(Editing by Jeffrey Heller and Catherine Evans)

Saudi-led air strike kills 26 people in Yemen: medics-[Reuters]-YAHOONEWS-November 1, 2017

DUBAI (Reuters) - An air strike by a Saudi-led military coalition killed 26 people at a hotel and an adjoining market in Yemen's northern Saadah province on Wednesday, according to medics and a Reuters witness at the scene. The attack which struck the Sahar district of the vast territory, on the border with Saudi Arabia, demolished the budget hotel and reduced market stalls outside to a heap of twisted sheet metal.Medics gathered corpses and laid them in a group.A military alliance led by Saudi Arabia has launched thousands of air strikes against Yemen's armed Houthi movement, which hails from Saadah and now controls much of the country. The 2-1/2 year war effort has yet to achieve its goal of restoring to power the internationally recognized government, but the conflict has unleashed one of the world's worst humanitarian crises and killed at least 10,000 people.Saudi Arabia and its allies, who receive logistical and intelligence help from the United States for their campaign, accuse the Houthis of being a proxy of their arch-foe Iran. The Houthi group denies those charges and says it is launching a patriotic resistance against outside aggressors in thrall to the West.(Writing By Maha El Dahan and Noah Browning; Editing by Catherine Evans)

Puigdemont claims to be Catalan 'president' from Brussels By Eric Maurice and Helena Spongenberg-EUOBSERVER

Brussels and Barcelona, 31. Oct, 17:58-[Updated at 8.15 on 1 November] Ex-Catalan leader Carles Puigdemont reappeared in public in Brussels on Tuesday (31 October), where he said he would continue to lead a government despite being dismissed by the Spanish government."One part of the government, led by me as the legitimate president, has come to Brussels in order to explain the Catalan problem in the institutional heart of Europe," he told a crowd of reporters packed into the Press Club, in the heart of the EU quarter.Puigdemont was with five members of the regional government that was dismissed last Friday. He said that the other "legitimate ministers" would continue to "carry out political activities" in Barcelona.Asked by EUobserver after the press conference, Joaquim Forn, who was in charge of home affairs, did not specify what these would "activities" would be or how the two parts of the team would work together from afar.Forn, together with Bassa, however flew back to Barcelona on Tuesday evening. They were met at the airport with people shouting "in prison" or "traitors".Puigdemont, who had left his hotel in Brussels, was also said to be on the plane, but he was not seen landing in Barcelona. His exact whereabouts were unkown on Tuesday morning.-Asylum? Puigdemont, who secretly travelled to Belgium on Monday, denied rumours that he came to request political protection."I'm not here to demand political asylum," he said, adding that he was in Brussels "as the capital of Europe" and that his presence there was "not a Belgian issue".But he did not explain why he took as a lawyer Paul Bekaert, who in the past worked for alleged members of the Basque terror group ETA.Bekaert later told the Flemish media VRT that "the possibility of political asylum is not yet completely off the table".Belgian prime minister Charles Michel said that the Catalan politician would be treated "as any European citizen, no more, no less".Puigdemont and 13 members of the dismissed government were summoned on Tuesday by a judge in Madrid. They are required to appear in the National Court on Thursday at 9AM, and were given three days to pay a combined deposit against potential penalties of €6.2 million.Puigdemont said that he would stay in Brussels as long as he could not get "guarantees" that he will receive a "fair treatment" in Spain."If we have guarantees, we would go back immediately," he said.He said he was in Brussels to "act with freedom and safety in order to take decisions."He argued that charges of rebellion, sedition and embezzlement open against him and 19 other separatist leaders were a "politicisation of the Spanish justice".He said that Spanish authorities were "persecuting an idea, some people, not a crime".Puigdemont, who tried before and after the 1 October independence referendum to get the EU involved as mediator between his government and the Spanish government, called on the "international community and especially Europe to react".He said that the absence of dialogue, as well as the risk of violence from far-right groups and what he described as "the imposition by military means and our imprisonment for 30 years" would "end with the idea of Europe"."It is a mistake that we can all pay at a very hight cost as European citizens," he said.-Packed press conference-Puigdemont's press conference was announced mid-morning and took place in the Press Club after the Belgian government vetoed the use of the Residence Palace, a larger venue just next to the European Council that is under the foreign ministry's management. While dozens of international journalists were packed inside, supporters of Spanish unity and Catalan independence were facing each others outside the Press Club.Belgian police were there to ensure that Puigdemont and his colleagues' taxis could safely enter and leave the building's car park.Puigdemont took several questions in English, French and Catalan but not in Spanish. In the morning, he held a meeting at the headquarters of the European Free Alliance (EFA), a network of nationalist parties that counts the Flemish N-VA, and the Scottish Nationalist Party among its members. An EFA source declined to tell EUobserver the purpose of the meeting or what kind of support Puigdemont would get from EFA.The source said that the logistics of Puigdemont and his five colleagues' stay in Brussels - whom he referred to as "the resistants" - were not yet decided for the long run.Puigdemont said that the strategy to go to Brussels was decided on Friday evening, after the Catalan parliament declared the region's independence and the Spanish government reacted by launching measures under article 155 of the constitution.Puigdemont said he had to "adapt" to a "highly aggressive and unprecedented offensive against the people of Catalonia".In Barcelona, Spanish officials said that Puigdemont was now "a normal person" and insisted that the priority for Madrid was "a return to normality as soon as possible.-"'No horror movie'-"All continues normally. There is no tension nor preoccupation," a government source told journalists after 155 Catalan officials were sacked in Barcelona, and in Catalan delegations abroad, since Friday."There is no horror movie here," the source said.A Catalan government civil servant however told EUobserver that there was a feeling of confusion among his colleagues over the coming weeks and months."No one knows what will happen," he said. The civil servant said he had not heard anyone at the office talking about disobedience. But "there are many ways of being disobedient if that is what people want to be."Another Catalan government source also told this website that officials abroad did not really know what would happen to them. The source, referring to Puigdemont, said that many wanted to "continue to work for the president".The Spanish government source insisted that "the independence process has ended" and that "the most democratic way to return to normality was to call elections.""It is to guarantee the neutrality of the administration – an administration for all the citizens and not just for a sector in the Catalan society," she said.Puigdemont in Brussels said that the elections, which will take place on 21 December posed "a democratic challenge" to the separatists. He said however that "if the Spanish state wants to make a plebiscite to legitimise article 155 and its policies, we will face it."He assured that he would "respect the result of the election as we have always done, whatever it may be.""Will the Spanish government and the '155 block' do the same?" he asked.-Pro-independence lead in first poll-In Barcelona, a first poll published just after Puigdemont's press conference, said that the outgoing pro-independence coalition, Junts pel Si, would win an absolute majority. It is not certain however that Junt pel Si will remain united. The Spanish government source in Barcelona did not want to speculate on the outcome of the December vote, and insisted that with "the result of the elections, the priority is that the law will continue to be respected, which we are sure it will.""The fact that [the separatist parties] have already confirmed their participation in the elections with the Spanish legality is very significant," she said."The 'normal' thing is that people vote," she added, using again the vocabulary of a a return to normality.

Justice commissioner links EU funds to 'rule of law' By Eszter Zalan-EUOBSERVER

BRUSSELS, 31. Oct, 18:24-EU justice commissioner Vera Jourova said Tuesday that the EU should consider creating stronger conditionality between the rule of law and the EU cohesion funds geared toward poorer member states. The Czech commissioner in a speech in Helsinki outlined how the EU executive could better uphold the rule of law across the European Union."[...] We need to make better use of EU funds for upholding the rule of law. [...] In my personal view we should consider creating stronger conditionality between the rule of law and the cohesion funds," Jourova said in Helsinki.Jourova's speech in Finland appeared to be directed partly towards Poland and Hungary. She recalled that in an earlier paper by the Commission in preparation for talks on the next seven-year EU budget, due to kick off next May, the executive said that upholding EU core values when developing and implementing EU policies is key, and that there is a clear relationship between the rule of law and an efficient implementation of the private and public investments supported by the EU budget.Jourova argued that "there will be no efficient regional and cohesion policy without the rule of law, because the corruption and fraud will leave their marks".Tying EU funds to rule of law issues, or political conditions has been a controversial issue, but is one that keeps popping up as discussions over the next EU budget cycle are approaching. Some net contributors to the EU budget have been arguing introducing such conditions that would help uphold the respect for common rules.Hungary and Poland-Concerns have been raised especially after governments in Hungary and Poland refused to accept asylum seekers under an EU scheme and have challenged the rule of law in their own country."The EU is not a project where we can pick and choose among the rules and obligations that apply. Nor is the EU a cash dispenser doling out money with no strings attached," Swedish prime minister Stefan Lofven said recently in a speech about Europe.Recipients of the EU's cohesion funds – designed to help the economic convergence of poorer areas – argue that it is counterproductive and against the treaty to tie EU funds to political conditions. The EU Commission has launched a rule of law probe on the Warsaw government the first time in its history, and the executive has been struggling to tackle Hungary's prime minister Viktor Orban's autocratic tendencies.-'Chain of Christmas lights'-Jourova attempted to unpick the arguments often used by Warsaw and Budapest against what they see as EU interference in the national judicial system. She argued that the rule of law is not only a national competence, because national courts have to uphold EU law. "This means that if one national system of judiciary is broken, the EU system is broken," she said."The judicial system in the EU is like a chain of Christmas lights. When one light goes off, others don't light up and the chain is dark," she added.Jourova also added that while the majority have the right to rule in a democracy, the rule of law ensures that the majority's power does not go unchecked."The essence of democracy is that the minorities know and trust that the law will protect them from the changes that go beyond certain limits," she said, adding: "In democracy, you cannot try to dismantle the judiciary, because you won the elections."Jourova also said in her speech that she would be in favour of an event to discuss how best uphold the rule of law in the EU.The EU has been struggling for years to tackle rule of law challenges, with several ideas floated in Brussels - from a special committee checking member states' rule of law, to stronger Commission oversight, to the use of the Article 7 that could eventually suspend the voting rights of an EU country. So far, EU countries have been reluctant to sanction one another over rule of law issues.

Brexit talks to resume next week By Eszter Zalan-NOV 1,17-EUOBSERVER

BRUSSELS, Today, 08:50-Brexit negotiators will resume talks next week with a month and a half left to achieve progress on key files before the EU-27 leaders meet in December to decide moving onto discussions on trade and future relations."Michel Barnier, the European Commission's Chief Negotiator, and David Davis, Secretary of State for Exiting the European Union, agreed today that the two teams would meet for Article 50 negotiations on 9 and 10 November 2017. An agenda will be published in due course," the UK and the EU said in a joint statement Tuesday evening (31 October).Dates for the new round of talks emerged after Britain's top Brexit official Oliver Robbins and Barnier's deputy, Sabine Weyand met in Brussels. Both the EU and the UK have pledged to accelerate talks. But with only 17 months to go before the UK leaves the bloc, the slow pace of negotiations has increased the possibility for Britain leaving without a deal. The EU proposed three new rounds, while the UK sought "continuous" talks."We have clearly proposed three [different dates] for new rounds. In the next few hours or days we'll be working with British delegations to find the right dates because we need to work in a very intense way to find this agreement before December," Barnier told reporters in Bratislava earlier on Tuesday.EU-27 leaders will meet in December, when they will decide if sufficient progress has been achieved on the financial settlement, the border between the Republic of Ireland and Northern Ireland, and citizens' rights. If leaders give the green light, talks can then move onto negotiations about trade and future relations with the UK.An EU official said on Tuesday the bloc is ready to accelerate talks, but there must be substance to those talks. One of the key sticking points has been the financial settlement between the UK and the EU. The bloc wants London to spell out what existing commitments it is willing to pay.The issue of the "divorce bill" is toxic for the UK prime minister Theresa May back home, as Brexit hardliners in her Conservative party oppose paying large sums to the EU.Davis on Tuesday told a House of Lords committee that the final financial deal is likely to favour the EU."The withdrawal agreement, on balance, will probably favour the [European] Union in terms of things like money and so on. Whereas the future relationship will favour both sides and will be important to both of us," he said.He also added that the UK wants a transition deal by early next year."We would like to see an implementation agreement in the first quarter of next year. That'll be the earliest we could possibly get it, in principle, because it won't be in fine detail in a couple of rounds of negotiations in January, but in principle," Davis said."By March next year, I am hoping we will have, intending we will have, an implementation period," he added.-Irish border issue-On the border issue, Davis admitted that it would be difficult to avoid a hard border, a key goal for the EU and Ireland, after the UK leaves the customs union."If we achieve an outcome, as we hope to, which maintains tariff-free trade, then maintaining an invisible border will be relatively easy," he said. "If we end up with a tariff arrangement, then we've got a real problem and dealing with that is difficult."A zero-tariff deal alone would not be enough however to avoid a hard border. As the UK wants to leave the customs union, checks would become necessary to ensure EU standards. The EU is awaiting proposals from the UK how to avoid the creation of such a hard border.
